Terms of service

Who you are dealing with#

These terms are a contract between you and Kazmaros Pty Ltd (ACN 695 478 721, ABN 71 695 478 721) of PO Box 1163, Milton QLD 4064, Australia, trading as websitebuilder.net.au (“we”, “us”).

Your account#

• You must be at least 18 and provide accurate details.
• You are responsible for keeping your password safe and for everything done under your account.
• One person may hold one Free plan.

Your content#

• You own the content you add to your site. You give us a licence to store, process and publish it, only as needed to provide the service.
• You are responsible for having the rights to everything you publish and for its accuracy and legality.
• We may remove content that breaches these terms, and we will tell you when we do unless the law prevents it.

Acceptable use#

You must not use the service to publish or link to:

• phishing, scams, malware, or anything designed to deceive or harm visitors;
• spam, or sites created only to manipulate search engines;
• content that is illegal in Australia, that infringes someone else’s rights, or that is defamatory, hateful or harassing;
• adult content, or content that sexualises minors in any form;
• material that impersonates another person or business, or falsely claims an affiliation.

We investigate reports and may suspend or remove sites that breach these rules, immediately and without refund where the breach is serious. To report a site, email abuse@websitebuilder.net.au.

Free plan#

Free sites include a small “Made with websitebuilder.net.au” link in the footer and are served at an address on websitebuilder.net.au. We may reclaim free addresses that are inactive for more than 12 months after emailing you.

Pro plan and billing#

• Prices are in Australian dollars and include GST. We issue a tax invoice for each payment.
• Subscriptions renew automatically monthly or yearly until you cancel. Cancel any time from your account page; you keep Pro until the end of the period you have paid for.
• Cancel within 14 days of your first Pro payment for a full refund.
• If a payment fails we will retry and email you. After 14 days your site moves to the Free plan; nothing is deleted.
• We may change prices with at least 30 days’ notice by email. Changes apply from your next renewal.

Australian Consumer Law#

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. Beyond what the law requires, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Availability#

We aim for the service to be available at all times but cannot guarantee it. We will give notice of planned maintenance where practical. Keep your own copies of important content and images.

Domains#

You keep ownership of any domain you connect. You are responsible for its registration, renewal and DNS. We do not register domains on your behalf.

Ending the agreement#

You can delete your sites and close your account at any time from your dashboard. We may suspend or end your account for a serious or repeated breach of these terms, and will refund any unused portion of a Pro subscription unless the breach was of the acceptable-use rules.

Changes to these terms#

We may update these terms. We will email account holders about material changes at least 14 days before they take effect.

Governing law#

These terms are governed by the laws of Queensland, Australia, and you agree to the jurisdiction of its courts.
